Terms of Service

These Terms set out the rules for using ComfyCoaching — software for personal trainers, provided as a subscription service (SaaS) in the browser at comfycoaching.com and in the mobile app (the “App”).

The provider is Michał Zych, residing at ul. Józefa Wybickiego 5C, 31-261 Kraków, Poland (the “Provider”), who operates the App under the name ComfyCoaching. Your contract for the use of the App is concluded with the Provider.

By creating an account or using the App, you accept these Terms.

The App is a tool in which personal trainers coach their own clients. A trainer account allows creating workout and diet plans, coaching clients, messaging and viewing their progress. A client account is created on a trainer’s invitation and allows doing workouts, keeping a meal log, tracking progress and messaging the trainer.

A trainer may publish a public page with their offer and a request form. Sending a request is not a purchase and does not conclude a contract. The coaching contract is concluded solely between the trainer and the client — the Provider is not a party to it and does not handle payments between them and is not responsible for the trainer’s offer, prices or delivery of their services.

The App is an organizational tool for trainer–client cooperation. The content and data in the App (plans, diets, measurements, tips) do not constitute medical advice, diagnosis or treatment and do not replace a consultation with a doctor or dietitian. Before starting training or changing your diet, consult a specialist, especially if you have health issues. The trainer who creates the plans and recommendations is responsible for their content.

By using the App, you undertake to:

• provide truthful information and keep your password secure,
• use it in accordance with the law and good practice; sending unlawful, offensive content or content infringing third-party rights, including copyright and other intellectual property rights, is prohibited,
• not use the App for fraud, spam or impersonating others,
• not attempt to bypass security measures or gain unauthorized access to other users’ data, including not introducing malware, not probing the App for vulnerabilities and not extracting data from it by automated means (scraping),
• not disrupt the App, e.g. by overloading it with requests.

The App, its software, design and the ComfyCoaching name belong to the Provider and are protected by law. For as long as you use the App, you receive a non-exclusive, non-transferable right to use it in accordance with these Terms. Content you add (e.g. plans, messages, photos) remains yours — the Provider uses it only to the extent needed to provide the service.

A trainer can use the App free of charge on the Free plan (with the limits described in the price list) or with a paid subscription. The price of a paid plan depends on the number of active clients; the price list is on the home page and in the App before purchase. Prices are shown in euros (EUR) and include VAT. Clients use the App free of charge, under their trainer’s account.

Our order process is conducted by an external online reseller, whose name and purchase terms are shown at checkout before you buy. It is the Merchant of Record for all our orders: it accepts payments, charges taxes, issues invoices and handles all payment inquiries and refunds.

The subscription is paid in advance, monthly or yearly, and renews automatically for the same period until you cancel it. The fee for the next period is charged to your saved payment method on the renewal date.

You can change your plan at any time. When you move to a higher plan, a prorated charge for the rest of the current period is taken immediately. When you move to a lower plan, the unused part of your payment is credited to your balance with that reseller and reduces your next payments.

You can cancel your subscription at any time in your account settings (Profile → Subscription management). Your plan then stays active until the end of the paid period, no further payment is taken, and the account returns to the Free plan — your data stays. If a renewal payment fails and is not settled, the subscription ends and the account returns to the Free plan.

You have 14 days from each payment to get a refund without giving a reason. The rules and how to request a refund are described on the Refund Policy page.

If you are a consumer (or a sole trader treated as a consumer), you also have the statutory right to withdraw from a distance contract within 14 days of its conclusion, without giving a reason. The refund policy does not limit this right.

You can delete your account at any time in the settings (Profile → delete account), which results in the deletion of your data in accordance with the Privacy Policy. Deleting your account cancels a paid subscription — no further payments will be taken.

The Provider may suspend or delete an account in the event of a material or repeated breach of these Terms, a threat to the security of the App or suspected fraud — after prior notice where possible.

The Provider makes every effort to keep the App working correctly but does not guarantee uninterrupted or error-free operation. To the extent permitted by law, the Provider is not liable for the consequences of training or nutrition decisions made on the basis of the App (see point 3).

You can submit complaints to contact@comfycoaching.com. We will respond within a reasonable time, no longer than required by law.

Matters not covered here are governed by Polish law; this does not deprive consumers of the protection afforded to them by the mandatory provisions of the law of their country of residence. We will announce changes to these Terms in the App; the date of the last update is shown at the top of the page.
